I don't know that merits of their claims but I do know that this is bad for ground based astronomy.

Starlink was always going to be primarily a rural and lower density suburban solutions but this just puts a little more confirmation of that. That is really an issue in higher user density areas. However it looks like SpaceX is prohibited from this based on Dish claim and FCC's response.
I have argued even if they did this the amount of layer that is feasible is limited and thus Starlink will never provide service to a large portion of urban users. In discussions about throughput limitations for a given location some of us have speculated SpaceX in theory could do beam layering that is use multiple sats to target a particular location and gain multiples of the throughput. Dish said in its filing that SpaceX satellites "would exceed the power limits and cause unlawful interference to Dish's satellite-television customers." While "SpaceX ultimately promised that it will restrict its operations to one beam in an area at a time," Dish said its studies "established that SpaceX will exceed power limits even using one beam in an area at a time."ĭish also said the FCC "failed to address the fact that SpaceX cannot meet its service-level obligations in connection with its Rural Digital Opportunity Fund subsidies unless SpaceX exceeds one beam in an area at a time." The FCC called this speculation instead of fact and said that, if SpaceX violates the condition, "it could face substantial penalties, including monetary forfeitures, and even revocation of its license."
